Royalist. His family estates were at Yester near Gifford in East Lothian. Hay married Jean Seton (1624), daughter of the 1st Earl of Dunfermline. Jean died a year later during child-birth and Hay married Margaret Montgomerie (1642), daughter of the Earl of Eglinton. Hay was created Earl of Tweeddale in 1646.
